Terms of participation
These terms govern participation in the hiclub Test loyalty programme — in the app, on the web and at the counter of participating businesses.
Die deutsche Fassung ist rechtlich verbindlich. This English text is a convenience translation. In case of any discrepancy, the German version prevails — read it here.
§ 1 Who runs the programme
hiclub Test is operated by Pale Blue Dot GmbH, Alte Kasseler Straße 52, 35039 Marburg (“we”, “the operator”). hiclub Test is a brand of Pale Blue Dot GmbH. Full operator details are in the legal notice.
We run the platform: the app, your account, the recording of your stamps and the evidence of which reward you have earned. The reward itself is provided by the participating business — see § 7 in detail.
§ 2 Who may take part
- Participation is open to natural persons who are at least 16 years old. You declare that you meet the minimum age when you accept these terms.
- One account per person.
- Participation is free of charge. Holding an account carries no obligation to buy anything. No contract for payment arises between you and us.
- There is no entitlement to participate.
§ 3 Account, guest account
- You get a regular account with your email address. You sign in with a one-time code we send to that address — there is no password.
- Guest account. If you scan a QR code at a counter while not signed in, we automatically create a guest account so that your stamp can be attributed. The same rules apply to a guest account as to a regular one. You can turn it into a regular account at any time by adding an email address. Until then, access to your stamps depends solely on the device and browser you scanned with — if its storage is cleared, the stamps become unreachable. We therefore recommend adding an email address.
- Do not pass your sign-in details or your customer code to anyone else.
§ 4 How stamps are earned
- A continuously changing QR code is displayed at the counter of a participating business. You scan it with the app. Alternatively, staff scan your loyalty card or the code in your app.
- A scan initially creates only a request. A member of staff approves or rejects it on the business's tablet. The stamp is credited only on approval. Nothing is issued automatically.
- A business may refuse a request. Stamps are issued per visit at the business's discretion within the programme rules — for example, not where no visit took place or where scans are repeated in quick succession. A scan alone does not create an entitlement to a stamp.
- A rejected or cancelled scan is not credited. You can repeat a scan that failed for technical reasons.
§ 5 Programmes and rewards
- A programme defines how many stamps a reward requires, what the reward is, and which businesses honour it. One programme may run at several businesses. All of this is shown in the app with the programme.
- Once the required number is reached, the reward is shown in the app as redeemable.
- A programme may be repeatable — a new round starts after redemption — or may lead on to a follow-on programme with a different reward. That too is visible in the app.
- While an earned reward is unredeemed, further stamps for the same programme are generally not credited. Some businesses allow you to keep collecting and redeem several rewards later.
- Stamps and rewards are not transferable, not tradeable and are not paid out in cash.
§ 6 Redeeming
- To redeem, present your code at the counter of a business where the programme applies. Staff scan it and confirm the redemption on the tablet. The reward counts as redeemed only upon that confirmation.
- Redemption consumes the stamps required for it.
- Individual promotional offers may additionally be limited in quantity, capped per account, valid only for a period, or — for student offers, for instance — restricted to a particular email domain. A reservation for such an offer can expire after a time limit and release the stock again. The applicable conditions are shown with the offer.
§ 7 Who owes the reward
- The participating business owes the reward. It is your contractual partner for the reward and provides it. We operate the platform that records your visits and evidences which reward you have earned. We do not promise the reward as a performance of our own.
- We advertise participating businesses' rewards in our app and on our website. That presentation does not change who provides them: rewards are provided exclusively by the business named.
- If a business refuses a reward or it is unavailable, that is in the first instance a matter between you and the business. Our role is limited to the stamp record: on request we will confirm to you what your account balance is and which reward had been earned. Do report such a case to info@palebluedot.de — we will follow it up and reserve the right to remove the business from the programme.
- For our own services we are fully liable under the statutory rules. That includes in particular operating the platform, recording your stamps correctly and completely, the accuracy of the information we ourselves publish, and the handling of your data. Paragraphs 1 to 3 do not limit that liability. Liability for injury to life, body or health and liability under the Product Liability Act remain unaffected.
§ 8 When a business leaves the programme
- Stamps you collected at a business are not voided if that business stops taking part. Stamps belong to a programme, not to a location: you can still redeem them at any other business where the same programme applies.
- If the programme applies nowhere else, we will ensure that the stamps you have already collected can be redeemed until their normal expiry (§ 9) — if necessary against an equivalent reward at another participating business. This undertaking is given by us as the operator, because you collected the stamps under our brand, even though the reward itself is provided by the business under § 7.
- If a programme ends altogether, we will announce it in the app and state a reasonable period within which earned rewards can still be redeemed.
§ 9 Validity and expiry
- Each programme may set a validity period for stamps and a deadline for redeeming an earned reward. Where such a period is set for a programme, it is shown in the app with that programme. Where none is shown, that programme's stamps and rewards do not expire.
- The periods may differ by city and by programme.
- A shortening does not apply retroactively. If a period is introduced or shortened, it applies only to stamps collected afterwards. Stamps already collected keep the period that applied when they were issued.
- Expired stamps and rewards are not replaced.
§ 10 Misuse
- The following in particular are not permitted: reproducing, photographing, passing on or manipulating the QR codes at the counter; creating multiple accounts; collecting stamps without an actual visit; using automated tools; and any attempt to circumvent the recording mechanism.
- The QR code at the counter is a continuously changing one-time code. A photographed code does not work outside its short time window.
- On reasonable suspicion we may cancel individual stamps or rewards, temporarily suspend the account and — for serious or repeated breaches — end participation and delete the account. We will tell you the reason and you may respond.
§ 11 Termination
- You may terminate at any time and without giving reasons by deleting your account in the app under Profile → Account. No message to us is required. What deletion does in detail is set out in the privacy policy.
- We may end participation on four weeks' notice, or without notice for good cause (§ 10).
- Unredeemed stamps and rewards lapse on termination. If participation ends at our instigation without good cause, earned rewards can still be redeemed for four weeks.
- No right of withdrawal, no cancellation button. Because no contract for payment is concluded through the app, there is no right of withdrawal under §§ 312g, 355 BGB and no obligation to provide a cancellation button under § 312k BGB. Deletion under paragraph 1 is available to you at any time regardless.
§ 12 Changes to the programme and to these terms
- We may change the programme and these terms, for instance when the set of participating businesses, the app's features or the legal requirements change.
- Every version of these terms carries a version identifier. On a change we will present the new version to you in the app and point out what has changed. You have four weeks to object. If you object, your participation ends when that period expires, and earned rewards can still be redeemed within a further four weeks.
- A change does not devalue rewards already earned.
- The current version is always the one published on this page. Its version identifier is given below.
§ 13 Applicable law, final provisions
- The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country of your habitual residence remain unaffected.
- We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
- Should any provision be invalid, the validity of the remaining provisions is unaffected.
